Judge Clears Rick Ware Racing to Sell NASCAR Cup Series Charter Amid LEGACY MOTOR CLUB Lawsuit

On Wednesday, a North Carolina judge delivered a pivotal ruling, denying LEGACY MOTOR CLUB’s motion for a preliminary injunction against Rick Ware Racing. The decision immediately allows Rick Ware Racing to lease or sell its NASCAR Cup Series Charter, even as an ongoing lawsuit continues to cast uncertainty over the situation. This turn of events comes after a temporary restraining order, granted on April 9, had put all Charter actions by Rick Ware Racing on hold, forcing the team to wait for the court’s determination on the injunction.

This legal matter centers on a contested sale agreement between Rick Ware Racing and LEGACY MOTOR CLUB. Specifically, LEGACY MOTOR CLUB filed a complaint on April 2, claiming that Rick Ware Racing had pulled away from what the team insists was a legally binding agreement to sell one of its valued NASCAR Cup Series Charters. The complaint, though heavily redacted, contends that a fully signed contract was reached by both organizations, and that every page was initialed as a sign of mutual consent. Despite this, LEGACY MOTOR CLUB alleges that Rick Ware Racing withdrew from the deal.

For Rick Ware and his team, Wednesday’s ruling marks a significant, if contentious, victory. Following the decision, Rick Ware, owner of Rick Ware Racing, stated, “RWR is gratified by the Court’s decision in this case. It’s good to be vindicated.” The ruling means the team is free to determine the Charter’s future, an important development as the team fields the No. 51 entry full-time in the NASCAR Cup Series and the part-time No. 01 entry for Corey LaJoie, while its second Charter is currently leased to RFK Racing.

Meanwhile, LEGACY MOTOR CLUB, which operates two full-time Chartered teams—the No. 42 with John Hunter Nemechek and the No. 43 driven by Erik Jones—continues to push for a third, full-time entry in 2025. The team’s ambitions have made the fate of this Charter critical, fueling the legal battle that now has far-reaching implications for both organizations.
