Busch’s concerns surfaced when he received a sixth annual premium notice for what was agreed to be a five-year plan. Sensing discrepancies, he and Samantha enlisted another independent firm to review the policy. The firm concluded that not only was the policy on the brink of lapsing within 16 months, but the $10.4 million invested had apparently disappeared.

“I was like, wait a second, what am I getting a sixth-year premium payment for?” Kyle Busch said in an interview. “We got on a call with the guy who sold me the premium policies and he ran me around in all these circles, couldn’t answer the questions, so I was like, this is fishy.”

The lawsuit seeks $8.5 million in damages from the insurance company. According to Busch, he was promised $8 million in annual payments starting at age 52 by investing $1 million annually over five years—a commitment Pacific Life Insurance allegedly did not fulfill, since the invested funds were not placed in the market but stayed in the insurer’s account.
