NASCAR Diversity Drive Faces Backlash: NASCAR, while currently only having three drivers of color in its ranks, is facing accusations of bias against white men from America First Legal, a conservative law firm with ties to Stephen Miller. The firm has asked the EEOC to investigate NASCAR, claiming that its diversity initiative discriminates against the 92% of its drivers who are white men.
NASCAR’s Drive for Diversity program, including Rev Racing, has been successful in attracting diverse drivers and aims to promote diversity among not just drivers but also pit crews. Since 2010, the program has nurtured 125 minority and female drivers, providing opportunities that were previously limited for drivers of color.
Leonard Miller, one of the first Black team owners in the 1970s, points out that prior to these initiatives, Black drivers had limited paths to getting noticed by NASCAR, including outstanding performance, white backing, or applying political and financial pressure.
America First Legal is specifically targeting Rev Racing, alleging that it violates Title VIII of the 1964 Civil Rights Act, which prohibits discrimination based on race or sex. Nick Barry, senior counsel of America First Legal, describes NASCAR’s program as illegal, emphasizing that drivers should be selected based on their ability to drive rather than their race and sex.
While the argument resembles the one used to end affirmative action in higher education, these are private businesses, not public education systems. It’s unlikely that conservative groups will succeed in thwarting NASCAR’s efforts to address historical disparities. NASCAR’s President, Steve Phelps, remains committed to promoting diversity and inclusion in the sport, despite the pressure from groups like America First Legal.
Phelps states, “I’m proud of the work that we’ve done in the areas of diversity inclusion to broaden our sport. We are going to continue efforts to have the entire country, the entire world, come to our facilities, watch it on television because it’s about a love for racing. I think … racing is a great opportunity for people to come together.”
